Last week the American Institute of Architects released the 2017 edition of the A201 family of contract documents, including updated versions of the AIA’s documents developed for the design-bid-build delivery model. The previous version of the design-bid-build contract documents included a Sustainable Project version.

The best way to mitigate risk in your green building project are properly drafted contract documents prepared by this law firm or by another attorney with green building experience. The document is simply that good. The American Institute of Architects has published standard form construction industry documents since 1888.

The new agreement allows a contractor and subcontractor to agree to a predefined set of terms and conditions that apply to multiple scopes of work. The Joint Venture Agreement for Professional Services also got a significant update.

AIA (American Institute of Architects ) form documents have dominated the construction industry for many years. Due to the AIA dominance, others in the industry sought out an alternative and the ConsensusDOCS were born in 2007. Many experts believe that the AIA standard form contracts are drafted to protect the Architect.

It is of interest that 61% of the contracts used at least a part of an AIA Contract Document form although most were older out of date versions and significantly only 8% used a correct AIA Sustainable Project Contract Document form. Only 1% used the ConsensusDOCS Green Building Addendum.
