At worst, Maryland could have been criticized along with the Federal government and other states, for failing to regulate PFAS as a hazardous substance.

Howard County, Maryland has become the first jurisdiction in the state and one of few places in the country to pass a mandatory “bird-friendly design” law for new construction of privately owned buildings. The bird-friendly design standards that the Director adopts by regulation and that are equivalent to Pilot Credit #55.

The Maryland legislature enacted enabling legislation permitting local governments to adopt the IgCC in 2011 and Baltimore will be the first to do so. Although as this bill is introduced, Montgomery County, Maryland is preparing legislation to repeal its existing LEED centric mandate replacing it with the IgCC. compliant.

On September 28, 2016, the County Executive of Montgomery County, Maryland submitted Executive Regulation 21-15, which adopts the International Green Construction Code 2012, to the County Council. If the Council does not approve or disapprove the proposed IgCC within 60 days after receiving it, the green code is automatically approved.

Green building will remain mandatory for new construction in Montgomery County, Maryland and effective December 1, 2017, the International Green Construction Code 2012 will be a permitted alternative. And the Council approved Executive Regulation 21-15 which adopts the IgCC 2012.
