This post is to alert our readers to a recent change in Mississippi’s mechanic lien laws recently signed into law by Governor Barbour ( Senate Bill 2363 ). In a nutshell, the law makes two changes: Previously, the law provided that suits to enforce liens must be filed in circuit court.

Well, PACE loans create a lien against properties similar to a tax lien, meaning that the lien has priority over all other debts (including mortgages). In the event of a default, the amount in default (but not the entire principal of the PACE loan) is a liability that is a property tax lien collected by the local government with the priority associated with other real property tax liens, so existing mortgage holder acknowledgment of a PACE loan is required.
