OSHA intends to publish the injury and illness data on a public website, which has raised concerns about privacy and cyber-security. The lawsuit contends that the rule unlawfully prohibits or otherwise limits employer safety incentive programs and routine mandatory post-accident drug testing programs.

Thanks to a new OSHA recordkeeping rule, employers urgently need to take a close look at their employee handbooks, safety policies and procedures, safety incentive programs, and drug testing policies. Of course, this raises a whole host of privacy, cyber-security, and other concerns. The new rule changes that.
