OSHA last year cleared the way for union representatives to accompany OSHA compliance officers on worksite inspections even if the union doesn’t represent the company’s workers, and now the consequences are being felt. All this potentially provides an opening for union organizers to get a presence in a non-union workplace.

Non-union employees can select anyone, including representatives of a union, to accompany an OSHA compliance officer during an inspection of their worksite, according to a recent interpretation letter issued by OSHA. In my opinion, if OSHA goes forward with this policy, it is likely to result in employer litigation.

Imagine inspecting a commercial project with 100,000 bricks, which would have nearly a mile-and-a-half of mortar joints. Modular design seems intuitive and natural, and masonry units lend themselves to the concept.
