As I thought about the green building policy mess of 2012, I couldn't help but draw comparisons to Game of Thrones. This was supposed to be the year of the USGBC's new green building rating system, LEED 2012. The USGBC long ago selected FSC wood as the anointed certification for wood products. Then the USGBC shifted its tactics.

It is surprising to many in the environmental industrial complex that there has been relatively little litigation arising out of green building. There have been only a very modest number of cases commenced in courts across the country involving construction of green buildings. Even the Green Business Certification Inc.

There is little question that a properly drafted provision in a contract requiring arbitration is enforceable. Arbitration is particularly wide spread in green building and has had the impact of so few green building disputes ever reaching a courtroom. Even the LEED Green Building Certification Inc.
