In recent months, we at FDRsafety have been surprised at the number of cases involving injuries resulting from falling objects. Where do gravity related accidents fall in the eyes of OSHA? In some cases OSHA is involved and in others, there is a civil suit alleging tort liability. The 7500 lb. load came down on him.

Using accepted ANSI standards, we are able to make use risk assessment, feasible risk reduction using the hazard control hierarchy and acceptable risk to solve real-world problems. When deciding that risk mitigation is needed, the concept of feasibility comes into play to demonstrate due diligence in complying with the OSH Act.

Recent cases (both OSHA and personal injury) suggest that industry’s quest to mandate employee performance may ignore the real world where workers encounter variables, and strict interpretation of the policy would literally prevent the work from being done. Enforcing machine lockout when lockout is not feasible.

Other signs suggest that the property owner or organization believes the caution provides some degree of indemnification in the event of an injury. The sign issues a warning but ultimately parents and children are left to their own best guess as to what might actually cause an injury. Below is my idea of a good safety sign.

General Duty citations from OSHA may not hold up. General Duty citations from OSHA may not hold up. If there is an OSHA citation most likely to be overturned on appeal to the Occupational Safety and Health Review Commission it would be one issued under the General Duty clause.
